These Terms of Service govern your access to and use of ArtistEngine.ai, Artist OS, artistdrvvynengine.com, related downloads, customer accounts, and managed services. ArtistEngine.ai is a product of DRVVYN Sound LLC (“DRVVYN Sound,” “we,” “us,” or “our”). By purchasing, downloading, activating, or using the product, you agree to these Terms.

The product

The free edition includes the self-hosted theme, catalog, content, profile, events, shop, forms, and public website features described on the product site. An active Full Experience subscription unlocks eligible managed Insights, Smart Links, Campaigns, Fans, connected services, private updates, training, and subscription support.

Feature availability may depend on your WordPress environment, hosting, jurisdiction, provider account, provider API access, and third-party terms. Advertising spend, payment-processing fees, merchandise costs, taxes, provider subscriptions, email overages, and other third-party charges are not included unless checkout expressly says otherwise.

Accounts and eligibility

You must provide accurate account and billing information, protect your credentials and license key, and promptly notify us of unauthorized use. You must be legally able to enter this agreement. You are responsible for activity performed by administrators and authorized users of your site.

Subscription, renewal, and cancellation

Full Experience is billed monthly in advance at the price displayed at checkout. Your subscription renews automatically using the saved payment method until canceled. Taxes may be added where required. You authorize recurring charges and may manage or cancel the subscription through the customer dashboard.

Cancellation takes effect at the end of the current paid billing period unless checkout or applicable law provides otherwise. Cancellation does not erase your self-hosted public website or WordPress content. After paid access ends, managed cloud synchronization, subscription support, new private updates, and other Full Experience services may pause or become unavailable. The free self-hosted features remain subject to these Terms and their software license.

We may change prices for future purchases. Existing subscription pricing will not be changed without any notice or consent required by law and the payment provider.

License and activation

Unless a product page states otherwise, one Full Experience subscription permits one production website activation and up to two local, staging, or development workspaces used for that same licensed website. The license is personal to the purchasing customer or organization and may not be shared, resold, sublicensed, or used to operate unrelated customer sites.

You retain ownership of your artist content and data. DRVVYN Sound LLC retains all rights in ArtistEngine.ai, Artist OS, software, branding, documentation, designs, and services except for rights expressly granted to you.

Your content and permissions

You represent that you have the rights and permissions needed for content, music, artwork, video, data, pixels, audiences, and connected accounts you upload, publish, synchronize, advertise, or sell. You grant us the limited permission needed to host, process, transform, and transmit that material solely to provide and secure the services you enable.

Acceptable use

You may not use ArtistEngine.ai to violate law or third-party rights; distribute malware; evade platform rules; misrepresent performance; access another customer’s data; interfere with security; scrape or reverse engineer protected services; send unlawful messages; or promote fraud, abuse, or deceptive advertising. Provider integrations must be used in accordance with each provider’s terms.

Third-party services

Connected platforms and payment providers are independent services. Their availability, data, policies, permissions, fees, and APIs may change. We are not responsible for a provider’s outage, account decision, data accuracy, or discontinued feature, but we will make commercially reasonable efforts to maintain supported integrations and communicate material impacts.

Updates and support

Private updates and subscription support require an active Full Experience entitlement. You are responsible for maintaining supported WordPress, PHP, browser, and hosting versions, backups, and security controls. Support does not include operating your advertising account, guaranteeing campaign performance, creating your content, or repairing unsupported third-party modifications unless separately agreed.

Disclaimers

The product and services are provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee streams, saves, chart positions, playlist placement, sales, followers, ad performance, uninterrupted provider access, or specific business results. Insights are informational and should be verified against authoritative provider records.

Limitation of liability

To the maximum extent permitted by law, DRVVYN Sound LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost opportunities, or third-party service decisions. Our aggregate liability arising from the paid services will not exceed the amount you paid to us for the affected service during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law.

Termination

We may suspend or terminate access for material breach, fraud, security risk, nonpayment, unlawful use, or conduct that threatens customers or the service. Where reasonable, we will provide notice and an opportunity to cure. Provisions that by their nature should survive termination remain effective.

Changes, governing law, and contact

We may update these Terms as the product changes. Material changes will be identified by a new version and communicated when required. These Terms are governed by the laws applicable to DRVVYN Sound LLC, without regard to conflict-of-law principles, except where consumer law requires otherwise.
